The owner of the online store www.tööriistamarket.ee (hereinafter Tööriistamarket e-store) is Järva Tarbijate Ühistu (registration code 10097762), located at Tööstuse 11, 72720, Estonia, Järva County, Paide.
Tööriistamarket e-store has the right to unilaterally change and supplement the conditions by publishing new conditions at the internet address www.tööriistamarket.ee. If the customer placed an order before the changes to the terms and conditions came into effect, the legal relationship between the customer and the Tööriistamarket e-store will be subject to the terms and conditions valid at the time the order was placed, unless otherwise provided by law or these terms and conditions.
Before making a purchase, the customer can save, print and, if necessary, reproduce the terms and conditions, and the customer agrees to the terms and conditions when making a purchase from the e-store.
In addition to the terms and conditions, the legal acts in force in the Republic of Estonia apply to making a purchase from the e-store.
Validity of the sales contract, product and price information
The terms of sale apply to the purchase of goods from the Tööristamarket e-store.
The prices of the products sold in the Tööristamarket e-store are indicated next to the products. All prices include VAT 22%. The price is subject to a fee for delivery.
The delivery fee depends on the delivery method. The delivery fee is displayed to the Customer when completing the order.
Information about the product is provided directly next to the product in the Tööristamarket e-store. Product information is checked and supplemented regularly. Since the product data is entered by the manufacturers, Tööristamarket e-shop does not take responsibility for the correctness of the product data.
Product images are illustrative.
Placing the order
To order the goods, you must add the desired products to the shopping cart. To complete the order, you must fill in the required data fields and select the appropriate method of product delivery. The amount of the fee is then displayed on the screen, which can be paid via a bank link or using another payment solution.
After paying for the goods, the Customer must click on the "Back to the merchant" link.
Order confirmation and invoice will be sent to the Customer's e-mail.
The order submitted by the Customer is a purchase and sale agreement between Tööristamarket e-store and the Customer. The Tööristamarket e-store accepts the contract when it begins to fulfill the order. If necessary, the Tööristamarket e-store reserves the right to cancel the order by informing the Customer.
If the Customer chooses "To the e-mail entered with prepaid invoice" as the payment method and does not pay for it within 3 days, the order will be canceled.
Items are available while supplies last. The Tööriistamarket e-store has the right to withdraw from the contract if the ordered goods cannot be delivered due to running out of goods or for some other reason. Tööriistamarket e-store informs the Customer of withdrawal from the contract as soon as possible either by phone, e-mail or mail. If the Customer has already paid for the ordered goods, the Tööristamarket e-store will refund the purchase price (including the costs of delivery of the goods) immediately, but within 14 days at the latest.
Orders placed in the e-shop are processed on working days (Mon-Fri) from 9:00 a.m. to 5:00 p.m. Orders placed on Saturdays, Sundays and public holidays will be processed on the following working day. This also applies to the "pick up the goods myself" delivery option.
A service fee may be added to the cost of the order in accordance with the agreement concluded between the Customer and the bank or credit card issuer.
The delivery of the goods takes place in Tööriistamarket stores during the opening hours.
The goods are issued to the customer upon presentation of an identity document (ID card, passport, driver's license) and the order number. In the absence of an identity document, the Tööriistamarket e-store may refuse to issue the goods.
Tööristamarket e-store is not responsible for damage caused to the customer, if, for reasons not attributable to Tööristamarket e-store, third parties have obtained a copy of the invoice or a unique order number and the goods have been received on the basis of this.
Delivery
Goods are sent only within Estonia.
The product can be ordered to Tööristamarket stores, Omniva parcel machine, DPD pickup point or to the address specified by the customer using the courier service.
The shipping costs of the goods are paid by the Customer, and the corresponding price information is displayed next to the shipping method.
Shipments generally arrive at the destination specified by the buyer within 3 working days from the entry into force of the sales contract.
Right of withdrawal
The customer has the right to withdraw from the contract within 14 days of receiving the ordered goods and exchange or return the goods. For free returns, you must use the same shipping method that the package was originally received. In case of withdrawal from the contract, the customer must return the goods immediately, but no later than within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
The goods may be tried on and inspected to ensure their suitability or non-suitability, but the goods and their packaging must be minimally affected during the trying-on. NB! Trial means equivalent use as is customary in retail establishments before making a purchase. E.g. you must not turn screws with a screwdriver, you must not mow the lawn with a lawnmower, you must not saw with a saw, etc. The returned product must be in the original packaging, with the original markings and in the same complexity as at the time of delivery to the customer. The goods, which arrive to the customer in a package that has been disassembled, must also be disassembled and packaged in the same way as when the goods were delivered to the Customer. If it is possible to open the packaging of the goods without damaging the packaging, the Customer undertakes to open the packaging in this way. Items attached to the product to protect the condition of the product (e.g. protective films), which do not prevent the product from being tried on and examined, must not be removed when the product is returned. In the event that the product has been purchased as part of a campaign, where another product has been added to the product, the entire set of products must be returned.
In the event that the original packaging of the goods is damaged or if the use of the goods during the trial period of the goods exceeds the reasonable extent necessary to get to know the goods or if the goods to be returned are not in a similar condition to new similar goods, Tööristamarket e-store has the right to unilaterally deduct from the amount due to be returned to the Customer corresponding to the decrease in the value of the goods compensation. The amount of compensation is determined each time, based on the extent of the possible decrease in the value of the returned goods, and the amount of compensation is notified to the Customer as soon as possible after the amount of compensation is determined. The postal service of the exchange item is free of charge for the Customer. The customer can return the parcel to the nearest Omniva parcel machine based on the personal code received via SMS upon receipt of the goods, or to the Tööriistamarket store. Tööristamarket e-store will return the free of charge by the Customer without delay, but no later than within 14 days from the receipt of the notice of withdrawal from the contract at Tööristamarket e-store.
If the Customer partially withdraws from the order, the return of transport costs will be made proportionally, according to the amount of returned goods from the entire order. For example, the Customer ordered 3 items and wants to return one of them, then 1/3 of the delivery postage must be refunded together with the price of the item.
In order to return the goods, a statement of withdrawal from the purchase of the goods must be submitted.

The customer must return the goods within 14 days after submitting the application or provide proof that he has handed over the goods to the carrier during the aforementioned period.
On receipt of the returned goods, the Tööriistamarket e-store shall return to the Customer all fees received from the Customer under the contract without delay, but no later than 14 days after receiving the withdrawal statement.
The Tööriistamarket e-store may refuse to make refunds until the item that is the subject of the contract has been returned or until the Customer has provided evidence that he has returned the item, depending on which occurs earlier.
If the Customer has explicitly chosen a delivery method other than the cheapest usual product delivery method offered by the Tööristamarket e-store, the Tööristamarket e-store does not have to return the cost to the Customer that exceeds the cost associated with the usual delivery method.
Järva Tarbijate Ühistu has the right to withdraw from the sales transaction and to demand the return of the goods from the Customer, if the price of the goods in the online store is marked significantly below the market price of the goods due to an error.
Damages caused to the product by natural forces are not compensated by the Tööristamarket e-store.
The right to file a claim
Tööriistamarket e-store is responsible for non-compliance of the goods sold to the Customer with the contract conditions or defects that already existed at the time of delivery of the item and that appear within up to two years from the delivery of the goods to the Customer. During the first six months from the delivery of the item to the Customer, it is assumed that the defect was already present at the time of delivery of the item. It is the responsibility of Töhiriistamarket e-store to refute the corresponding assumption.
If the diagnostic result shows that the defect has occurred due to the consumer's error, the Tööristamarket e-store can organize a paid repair for the Customer or send the product back to the Customer. If the Customer does not agree with the diagnostic result, he has the right to get a second opinion, the costs of which will initially be covered by the Customer.
After the 6-month period has passed since the purchase of the goods, the Customer himself must prove that it is a manufacturing error, and not a defect caused by the wrong use of the consumer himself. The customer organizes the diagnostics himself and sends the work record prepared as a result to the Tööriistamarket e-store. In case of disagreement with the conclusion of the employment report, the Tööriistamarket e-store has the right to organize a second examination, the costs of which will be initially covered by itself. If the Customer does not have the opportunity to organize diagnostics, Tööristamarket e-store can recommend the workshops of its partners. The costs related to this are covered by the Customer until it is proven that the product was defective. Claims can be resolved in the form of a partial refund, product return, exchange or repair.
Tööriistamarket e-store is not responsible for product deterioration/damage due to the Customer's fault; for defects that have arisen as a result of improper use of the product; for normal physical wear and tear of the product under normal use.

The Tööriistamarket e-store is not responsible for defects that have occurred after the goods have been handed over to the buyer.
If a product purchased from the Tööristamarket e-store has defects for which the e-store is responsible, the e-store will repair or replace the defective product. If the goods cannot be repaired or replaced, the e-store will return to the buyer all fees associated with the sales contract.
Tööriistamarket e-store responds to the consumer's complaint in writing or in a form that enables written reproduction within 15 days.
Disputes arising during the execution of the contract are tried to be resolved through negotiations. In case of failure to reach an agreement, the disputes will be settled by court in accordance with the legislation in force in the Republic of Estonia. The customer has the right to contact the Consumer Disputes Committee at the Consumer Protection Board for out-of-court settlement of disputes arising from the Agreement. Exercising the right to appeal to the Consumer Disputes Commission does not deprive the Customer of the right to appeal to the court for dispute resolution.

Warranty conditions
The warranty covers product material and manufacturing defects. Normal wear and tear of the products during operation is not covered by the warranty. The same applies to products that are incorrectly installed, poorly maintained, misused, injuries caused by other external factors.
In the case of a guaranteed product, Tööristamarket undertakes to repair or replace the product with an equivalent product, in the event that material or manufacturing defects have caused the product to become unusable. If the product cannot be repaired or replaced, 100% of the product cost will be reimbursed.
Tööriistamarket does not undertake to compensate the costs associated with the exchange of products damaged during the warranty period or the costs of transporting the product to the warranty.
The period for submitting claims for private individuals is 24 months for products:
The warranty period for all products is 1 year, except for products for which the manufacturer has given a longer warranty period.
The warranty period starts from the date of the invoice
Repairing or replacing the product during the warranty period does not extend the original warranty period.
Products that have been dismantled are not eligible for replacement under warranty. Also products that have been tried to repair themselves.
The warranty examination is carried out at the expense of Tööriistamarket.
If the customer disputes Tööristamarket's decision regarding the product warranty, he has the right to order an impartial expert opinion from an institution with a corresponding license. Expertise costs are borne by the expert customer. In the event that the expertise proves the fault of the product and Tööristamarket accepts the expert's decision, Tööristamarket will cover the costs.
A defective product that has been refunded will not be returned.
If the product is not accepted under warranty, and the person making the warranty claim does not demand the return of the product, Tööristamarket has the right to dispose of the product after 120 days.
Direct marketing and personal data processing
Tööriistamarket e-store uses the personal data entered by the buyer (including name, phone number, address, e-mail address, bank details) only to process the order and send the goods to the buyer. Tööriistamarket e-store forwards personal data to companies providing transport services in order to deliver the goods.
Tööriistamarket e-store sends newsletters and offers to the buyer's e-mail address only if the buyer has expressed a wish to do so by entering an e-mail address on the website and has indicated his wish to receive direct mail notifications.
The buyer can opt-out of offers and newsletters sent to e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.
Dispute Resolution and Liability
If the buyer has complaints about the Tööristamarket e-store, they must be sent to the e-mail address epood@trm.ee.
Disputes arising during the execution of the contract are tried to be resolved through negotiations. In case of failure to reach an agreement, the disputes will be settled by court in accordance with the legislation in force in the Republic of Estonia. The customer has the right to contact the Consumer Complaints Committee at the Consumer Protection Agency for out-of-court settlement of disputes arising from the Agreement. Exercising the right to appeal to the Consumer Complaints Commission does not deprive the Customer of the right to appeal to the court for dispute resolution. Tööristamarket e-store is responsible to the customer, and the customer is responsible to Tööristamarket e-store to the other party for the damage caused by violation of these terms and conditions in the cases and to the extent provided by the legislation in force in the Republic of Estonia.
Tööristamarket e-store is not responsible for damages caused to the customer or for delays in product delivery if the damage or delay in product delivery is due to a circumstance that Järva Tarbijate Ühistu could not influence and whose arrival was not foreseen and could not have been foreseen (force majeure).
